The L.A. City Attorney has rejected Playboy model Dani Mathers' attempt to avoid jail time after nude gym photo.

Playboy playmate Dani Mathers could face jail time over her Snapchat post of a naked woman at the gym.

The L.A. City Attorney has filed legal documents to reject attempts by the model’s lawyer to avoid jail. Instead her lawyer said that Mathers would undergo counseling and take an anti-bullying course.

Mathers famously shared a widely mocked apology video, in which she claimed that taking and sharing the photo to Snapchat had been an accident.

“I have chosen to do what I do for a living because I love the female body, and I know that body shaming is wrong and that’s not what I’m about,” she had said.

Mathers had also tried to defend her actions by claiming it was a picture she had meant to share with a girlfriend – and not all of the internet – but which she had accidentally posted to her story because she is “new to Snapchat.” Not that any of that makes it okay.

However, much like the rest of the internet, the L.A. City Attorney was not buying Mathers’ apology. They pointed out that she had never even apologized to the 71-year-old in the photo – after posting the picture without the woman’s consent.

Mathers had also shamed the poor, unsuspecting woman by captioning the despicable post, “If I can’t unsee this then you can’t either.”

Now the 2015 Playboy Playmate of the Year could face up to six months in jail for posting the Snapchat photo, for the crime of invasion of privacy.

The City Attorney has not specified whether or not they will be pushing for jail time, although they are clearly not taking the issue lightly.

And though the City Attorney seems to be taking the crime very seriously, Mathers’ attorney claims it is just a “pathetic” attempt to “get a pound of flesh.” Mathers’ attorney has also called the case a waste of taxpayer money.
